You are entitled to up to 2/3rds of your average weekly wage. Depending on your average weekly wage and your percentage of disability, you may be below, at or above the maximum.

How is Average Weekly Wage Calculated?

Average weekly wage is based on your wages from the year prior to the accident. If you are salaried and essentially receive the same amount every week, that will be your average weekly wage. If your earnings have fluctuated, or if you have held multiple jobs or gone through various promotions, calculating average weekly wage may be slightly more challenging. At the Robert A. Are You Entitled to the Maximum?

After your average weekly wage is calculated, your percentage of disability will be taken into account. Percentage of disability is a number assigned by the doctor indicating to what extent you are disabled. If you are 100% disabled, you may be entitled to the full 2/3rds of your average weekly wage, provided it does not exceed the maximum. If the doctor says you are 25% disabled, you may only be entitled to that portion of your average weekly wage.
