Over Age 50 Claims

New York City Disability Claim Lawyers

To be eligible for Social Security Disability Insurance (SSDI) benefits, you must prove that you suffer from a physical or mental disability that is expected to significantly impair your ability to work for at least 12 months. Unfortunately, it is not enough to prove that you are unable to return to work in your previous occupation.

Even if you are a construction worker, factory worker or laborer who is unable to perform heavy lifting or other physical tasks which are necessary to return to your previous occupation, your application for benefits will be denied if it is determined that you could return to work in an office job or other field of employment that does not require intense physical labor. The same is true for an office worker or professional who is unable to return to his or her previous occupation, but who may be able to work in another occupation.

SSDI Claims if You Are 50 or Older

If you are age 50 or over, it is assumed that it is more difficult to transition to a new field of employment. The Social Security Administration recognizes that it may be difficult to learn an entirely new profession, go back to school or take other critical steps necessary to transition to a new occupation if you are 50 or over.

While it may be easier to obtain benefits once you reach age 50, many applicants who are 50 or over still have their applications denied. It is critical that you retain an experienced SSDI attorney who will work diligently to provide the quality legal representation you need.

Our firm has handled many over age 50 claims on behalf of clients who need SSDI benefits. If retained as your counsel, we will take time to learn about your impairments and understand how they have impacted your ability to maintain gainful employment. We also have significant experience advocating on behalf of clients who are under 50.

Let us put our experience to work for you. We have helped hundreds of clients in Social Security Disability cases, and we are committed to providing our clients with the knowledgeable, dedicated and highly personalized representation they need.
