What Is Social Security Disability Insurance (SSDI)?
Social Security Disability Insurance is a monetary safety net provided by the Social Security Administration to people with qualifying disabilities. Benefits are paid to individuals who have been in the workforce for a minimum number of years. Generally, you must have been employed for 10 years, with five of those years prior to the date you became totally disabled. For impaired children or disabled adults without a strong work history, Supplemental Security Income (SSI) may be an alternative option.
How Does the Process Work?
Either with the help of our attorneys or on your own, you must complete an initial application and submit medical documentation of your impairment. Providing medical evidence that documents the full scope of your impairment is one of the most important components of your claim for disability benefits.
Many claims are initially denied. Following a denial, you have 60 days to request a reconsideration hearing. At the hearing, we will help you demonstrate why your limitations are serious enough to qualify you for disability benefits.
The next step in the process is to have your case heard by an Administrative Law Judge. The judge examines your disability and work limitations. He or she will also consider a number of additional factors including your age, education, skills and employment history. If it is determined that you cannot adjust to a new form of work, you may receive benefits.
