What Money / Benefits Can I Recover?

New York Workers' Compensation Law Firm

One of the most important things people want to know after a workplace accident or job-related injury occurs is this: What medical and income benefits can I expect? This question is a natural one and has nothing to do with greed or a desire to "freeload" off their employer. It is simply about the economic realities that not being able to earn a paycheck and the high cost of medical care create.

Our attorneys can answer your questions and provide the skilled legal representation you need to navigate through the new system and obtain the benefits you're entitled to. Contact us.

At the Law Office of Robert Koenigsberg, we have been protecting injured workers' rights in New York City and its surrounding areas for more than a decade. In that time, our knowledge of the law, our familiarity with the people who make the system run, and our dedication have produced successful results for hundreds and hundreds of previous clients.

If you were injured prior to March 13, 2007, $400 is your weekly maximum benefit for lost income. Any permanent partial disability may enable you to receive lifetime workers' compensation payments.

If you were injured on or after July 1, 2007, you may currently expect to receive as much as $500 in weekly income benefits under the new workers' compensation laws depending on your salary.

In either situation, the process for obtaining income and qualified medical benefits will be similar. Essentially, you have 30 days to notify your employer from the time you were injured or diagnosed. In the interim, you should obtain the medical attention you need (we can help you find appropriate care). The doctor will call your employer to obtain their insurance information. Your employer will notify the insurance company. Your employer will create an accident report and submit it to their insurer. Your physician will do likewise with his or her medical report. You should begin to receive insurance payments - if you do not, something may have gone wrong.
