Hepatitis C Case:

  • In a case involving a dental worker who had been exposed to human blood during the course of her work, we were successful in having the Workers' Compensation Board establish that the client's hepatitis C was the result of her exposure to this blood. We prevailed by showing that in all likelihood, since no other factors could have caused this condition, the exposure to blood would have had to have been the precipitating factor. The insurance company had argued that since no specific dental patient had been identified with Hepatitis C she was not entitled to benefits.

Psychiatric & Psychological Injury Cases:

  • We have been successful in prosecuting many cases in which injured workers have developed depression due to having been forced to remain out of work following devastating work-related injuries. Needless to say, almost all psychological claims are heavily contested.
  • We were recently successful in having a case accepted for depression on behalf of a woman who had been harassed and intimidated by a male supervisor. He had made significant unwanted advances and we were successful in showing that this, more than any other factor in our client's life, precipitated her depressive disorder.

Occupational Disease Cases:

  • We have recently been successful in negotiating a settlement for $249,000.00 for injuries sustained by an executive who developed significant pain in her hands from overuse of the keyboard.

World Trade Center Cases:

  • Our office has been successful in assisting over 25 workers injured at the World Trade Center attack. Many of these claims arose from the attack itself and many arose following exposure to pollutants in the air during the clean-up phase.

Death Case:

  • Our office has recently successfully concluded a case in which a cleaning woman was murdered on her job and left several small children surviving her in Mexico. Although the case was initially challenged by the insurance company, we were not only successful in obtaining awards, but also were able to show that this woman had a second job, and therefore a greater salary, and her children were entitled to a portion of that additional lost income. Finally, we obtained all the necessary documentation from Mexico to enable her children to receive their just compensation.

Fraud Cases:

  • We recently were successful in overcoming insurance company allegations in several cases involving alleged fraud. Many of the fraud allegations involve videotapes submitted into evidence by investigators from the carrier. In one instance, we were able to show that the videotape allegedly of our client was in fact the client's cousin.
  • In another matter, in which the carrier alleged that our client was the superintendent of a building and working at that building, we were able to successfully show that his wife was the superintendent and our client had in fact been unable to work.
