The full impact of workers' compensation reform is still unclear. What is known is that under the new law:

  • Almost all permanent partial disabilities are gone. Under the new system, payments for permanent, partially disabling injuries will be based on a sliding scale and capped in the number of years of payout.
  • Diagnostic providers and pharmacies may be chosen by your employer's workers' compensation insurance carrier. Eventually, they will probably be able to choose your physician as well.
  • On July 1, 2007, the maximum benefit was increased to $500 per week. This will be increased to $550 per week on July 1, 2008; to $600 per week on July 1, 2009; and to an amount equal to two-thirds of the state's average weekly wage per week on July 1, 2010.
  • Under the old law, medical providers had to obtain advance authorization from the workers' comp insurance provider for any service exceeding $500 in nonemergency situations. The new law allows providers to render services costing up to $1,000 without obtaining prior authorization.
